LAKE CLUB FACILITY CLOSURE
 
UPDATE – 4/2/2020
 
THE LAKE CLUB FACILITY WILL BE COMPLETELY CLOSED DUE TO THE STATE AND FEDERAL MANDATES FOR COVID-19 UNTIL FURTHER NOTICE
 
 
Based on the most current guidelines, these closures have been extended. As of today, the following is in effect:
 
All Lake Club amenities and facilities are closed, including but not limited to, the office, Clubhouse, parking lot, courts, fishing lake, playgrounds, walking trails, etc.
 
The office staff is available by phone and email to assist you during regular office hours. There is a drop box located in the door of the gate station which is available at all times for paperwork and payments (no cash). 

 
We hope that you and your families remain healthy and safe.

What is the process to get owners to abide by the rules and keep up their rental property?
As fellow homeowners, the Board of Directors understands the frustration that some homes on the Ranch are in disrepair and with landscaping that gravely needs attention.  Unfortunately, irresponsible homeowners encompass owner-occupied properties, as well as, rental properties.  That said, our Non-Compliance Process is the same.  All communications are directed to the homeowner of record and not to the residents of the property.
 
During our September 2019 Open Forum meeting we reviewed the “Non-Compliance Process” document with homeowners. This process document shows the steps Sunnymead Ranch PCA takes in order to encourage homeowners to comply with the CC&Rs. This process for enforcement is governed by the State of California and our CC&Rs. Unfortunately, for those of us who maintain our properties, it may be viewed as a very slow process.  Often times homeowners think that because a property stays in disrepair for a long period of time that nothing is being done. We assure you that that is not the case, they are certainly in the process.

Sunnymead Ranch PCA has a Facebook Page
Please log into www.mysunnymead.com and hit the Facebook icon on the home page. This will take you to our Sunnymead Ranch PCA Facebook Page. Please like the page. We will update information on our page so that you can see what is going on in Sunnymead Ranch. We are very excited about this upgrade.
 
Architectural Applications
This is a reminder that anything you do on the outside of your residence which includes the rear yard; landscape, painting, replacement, additional concrete, pool etc., requires an architectural application to be reviewed and approved by the Architectural Committee prior to proceeding with the project. This includes re-painting of houses and fences as well. Give yourself plenty of time to submit an application and wait for the approval. You are always welcome to attend the Architectural meeting.
 
Assessment Payments in the Drop Boxes
The gate station and the office have drop boxes for the convenience of the resident in the community giving them the ability to drop off their assessment payments twenty-four hours a day, seven days a week. It is the responsibility of the resident to drop the payment in the box and to not hand it to a member services representative in the gate station. The payments can be money orders, cashier’s checks or checks only. No cash is allowed in the drop box. The office no longer takes cash for any type of payments. Thank you for your cooperation in this matter.
 
Spring House Painting and Touch up
Spring is just around the corner. This is a great time to paint trim, garage doors, fences, gates and houses. Remember to submit an Architectural Application for approval before starting any improvements on your home.
 
Member Services Representatives
There has been a common practice of calling the gate station representatives, guards. The name the Association uses is member services representatives. Currently, they are charged with access control and patrolling the common areas. They are to observe and report only. They do not assist in any patrolling of personal property or noise complaints within the community.
 
 
 
 
 
Cleaning of the Fitness Center
Just a reminder that the Fitness Center is closed from 1:00 p.m. to 2:00 p.m. daily for the purpose of cleaning the Center. Because the Fitness Center is in need of cleaning every day, we are asking for everyone’s cooperation. A much better job is done if there is no one in the Fitness Center when the custodian’s clean. This takes about an hour. Thank you for your patience in this matter.
 
Safety and Security Reminder
This is a reminder to all residents that they are responsible for their own safety and security in the community as well as the common areas.
 
Things Your Burglar Won’t Tell You (Part I)
This is actually a great list filled with some tips that you may have never thought of, so we are passing this along for your review. It is a lengthy list so I will put a few in each of the upcoming newsletters:
Things your burglar won’t tell you:
1.   Of course I look familiar; I was just here last week cleaning your carpets, painting
      your shutters or delivering your new refrigerator.
2.   Hey, thanks for letting me use the bathroom when I was working in your yard last
      week. While I was there, I unlatched the back window to make my return a little
      easier.
3.   Love those flowers. That tells me you have taste…and taste means there are nice
      things inside. Those yard toys your kids leave out always make me wonder what type
     of gaming system they have.
4.   Yes, I really do look for newspapers piled up on the driveway. And I might leave a
      pizza flyer on your front door to see how long it takes you to remove it.

Dear Sunnymead Ranch Homeowner Members:

1.  Due to an upcoming change in Civil Code (effective January 1, 2020), any Association Member may request to inspect an Association “membership list”.

2.  The “membership list” will include information that you may consider private but that may be used by other Association Members.  This information includes: Name, Property Address, Mailing Address and Email Address.

3.  The Association is reminding members of their ability to “opt out” of providing your personal and private information to other members pursuant to Civil Code Section 5220.

4.  Opting Out
     You may “opt out”, if you do not wish to have your private information (Name,
      Property Address, Mailing Address, and Email Address) included on the
      “membership list” requested by other members

important notice - pedestrian gate use

PEDESTRIANS WALKING INTO THE CLUBHOUSE FACILITY WILL USE THE PEDESTRIAN GATE ENTRANCE NEAR THE VETERAN’S GARDEN AND NOT THE MAIN VEHICLE ENTRANCE
 
It has come to the attention of the Executive Committee that it is a safety and liability issue when pedestrians utilize the main vehicle entrance to enter and exit the Clubhouse facilities. Pedestrians are being asked to not walk through the main vehicle entrance.
 
There are several pedestrian gates throughout the community in which pedestrian traffic can enter into the Clubhouse facilities. The entrance from Sunnymead Ranch Pkwy, which is the closest pedestrian entrance to the clubhouse facilities, is located near the Veteran’s Garden and is accessible by using an access card.
 
Thank you for your understanding in this important safety matter.

understanding the open forum

Let's suppose that you attended a recent Board of Directors meeting here at Sunnymead Ranch, and it was your first time doing so since moving into the community.   And, one of the first things you had an issue with  understanding, was the term “Open Forum”, that appeared on the meeting agenda.  You might have also thought, “what exactly did it mean, or how did it operate during the meeting”?  Both fair questions to ask.  In fact, even some of the more seasoned-attendees don't always understand completely what and how open forum works at our meetings.
 
So, let's clear the air a bit, in trying to explain the form and protocol of how open forum works here at our Board of Director meetings.  To start with, and as many of you already know, Sunnymead Ranch holds monthly Board of Director's meetings at our Clubhouse.  Recognizing that, it's important to remember that our board meetings are meetings of the association's board of directors, and not a meeting of association members. Accordingly, members do not have a right to participate in the board's discussions and votes. By statute, members can observe the board conduct business.

In addition to observing board meetings, members can address the board during what's known as the open forum portion of the meeting. This is the same policy followed by municipalities at our city council meetings. Open forum for associations applies to open (non-executive sessions) board meetings (according to Civ. Code §4925) and membership meetings (according to Civ. Code §5000(b)). At that time, members can speak on any issue, whether on the agenda or not (according to Civ. Code §4930(a).)  This portion of the meeting has its own rules that apply, which will be explained below.
 
Although members do not have a legal right to participate in board discussions, the president (or acting-chair) can invite comments from the audience on particular items of business, if he or she so chooses. This is at the discretion of the board. Once comments have been received, discussion can be closed and a vote taken by the directors (or the matter can be tabled to a future meeting).
 
The first rule that applies to open forum is that the Davis-Stirling Act requires that a reasonable amount of time be set aside by the board for the open forum.  The second rule is that members may ask questions, but the board's ability to answer them is limited by statute. As provided for in(Civil Code §4930(b), boards may briefly respond to statements made or questions posed;  or ask a question for clarification, make a brief announcement, or make a brief report on the person’s own activities, whether in response to questions posed by a member or based upon the person’s own initiative.   
As far as the topics that open forum can include or address, the Open Meeting Act allows the board to establish reasonable time limits (typically up to 3-minutes per speaker) but there is no limit on the number of topics members can raise. (Civ. Code §4930(a).) Boards also cannot create unreasonable rules  that would stifle a member's right to address the board.   Boards can, however, place reasonable restrictions on some topics. For example, personnel issues should be addressed privately with the board or in writing to the board, and not publicly. And, for example, topics should not:
  • involve a matters outside the board's authority,
  • be defamatory, indecent, abusive, or involve personal attacks or threats, legal or otherwise,
  • involve personnel issues,
  • involve the disclosure of confidential information,
  • maintenance issues can be raised during open forum but are often better addressed in   
  writing with the management company.
 
In simple terms, here is how open forum is designed to work:
 
 -   A member who wishes to speak during open forum will fill out a Speaker's Form, located at the 
     sign-in desk;
 -  The form will be filled out and returned to our General Manager, Ms. Betty Roth;
 -  Once open forum begins (according to the agenda) each speaker will be asked to come up to the  
    dais and address the Board (and not the members);
 -  Each speaker will be given up to three-minutes to speak, and a visible clock will alert them of the 
    time-expired;
 -  Each speaker will be given their time to speak on any topic that is allowed;
    The board (by statute) is not required to respond to, nor answer questions posed by the speaker at
    that meeting;
 -  Next speaker is asked to address the Board, until all speakers have had an opportunity to do so.
 
Often times open forum is assumed to have inherent rights of “free speech” being attached to the opportunity to address the Board through open forum.  The fact is that free speech issues are often misunderstood when it comes to community associations. First Amendment constitutional protections apply to governmental restrictions on free speech and do not apply to private organizations. Common interest developments are private property where constitutional rights to free expression are limited. (Hudgens v. National Labor Relations Board (1976) 424 U.S. 507; finding no First Amendment right to free expression on private property.) The same is true for state constitutional protections. In Golden Gateway v. Golden Gateway, the California Supreme Court made it clear that the California Constitution protects against restrictions by the state, not private organizations. It's always important to remember these limitations as well as restrictions, when it comes to members using the open forum at our meetings.
 
And always keep in mind that open forum is designed to allow each and every one of our members to address the Board about their concerns in the governance of our association, and each and every one of our members is entitled to exercise that opportunity.
